MAKE TYPE NOT WAR! occasionally offers its customers in addition to the licensing of fonts / typefaces via its website („Site“) www.maketypenotwar.com products (hardware) for sale. The following terms and conditions of sale (“Terms”) apply to the sale of products through the Site. The special provisions of the EULA (End User License Agreement, found on www.maketypenotwar.com under the heading „Licensing“ apply to the licensing of typefaces.
The Conditions regulate the sale of MAKE TYPE NOT WAR! products (hereinafter the “Products” or the “Product”) via www.maketypenotwar.com to the customer (hereinafter the “Customer” or “You”). MAKE TYPE NOT WAR! hereby expressly rejects the application of any general terms and conditions and sales conditions of the customer. Such conditions can only become part of the agreements concluded between the contracting parties if they are expressly confirmed in writing by MAKE TYPE NOT WAR!.
All customers who want to make a purchase on the site represent and guarantee that they are doing this only for their own account, that they are at least 18 years of age, have full legal capacity or have been given the appropriate authorization by a parent or legal guardian. By placing an order, each customer automatically declares himself to be in agreement with these conditions of sale and assures that he will adhere to them.
The terms and conditions, as well as prices, products and guidelines may change from time to time and subsequently be changed by MAKE TYPE NOT WAR! at its sole discretion. The conditions of sale are deemed to have been accepted and are legally effective when MAKE TYPE NOT WAR! informs the customer of the validity of the conditions of sale and the customer subsequently places an order. The customer is responsible for viewing these conditions before placing an order so that he is informed of the valid version of the conditions.
“Consumers” in the sense of the sales conditions are natural persons who conclude the contract with MAKE TYPE NOT WAR! for purposes that are not primarily commercial or for the execution of activities by freelance business people.
“Entrepreneurs” in the sense of the sales conditions are all customers who act in their capacity as commercially active business people or in the context of their activities as freelance business people.

Due to the processing of images by computer and although a considerable amount of effort has gone into the production of our product pages, it is possible that the colors shown on the site may differ slightly from the actual colors.
PRODUCT AVAILABILITY
The products offered for sale and their prices are valid for as long as they are offered on www.maketypenotwar.com, subject to availability.
If, contrary to expectations, a product is no longer available after placing the order, or if there are changes to the expected delivery date, the customer will immediately receive an email to the address given when ordering. Regardless of existing legal claims, the customer as a consumer can cancel the order or make changes to his order before the goods are dispatched at no additional cost to him. If the customer is an entrepreneur, the entrepreneur grants MAKE TYPE NOT WAR! a reasonable grace period in the event that the delivery date cannot be met.
If the customer card has been charged for any reason, the full payment amount will be refunded to the customer card used as payment method.
PRICES
All prices displayed on www.maketypenotwar.com are given as net prices, excluding the applicable VAT amount and the costs of shipping. Additional fees may apply if you choose express delivery. Any additional costs in this regard are specified separately in the shopping cart.

The customer can make a purchase on www.maketypenotwar.com without setting up an account.
PLACING AN ORDER, CONCLUDING A CONTRACT, LANGUAGES
The images of goods in catalogs, advertising media and on the site are not legally binding and do not constitute an offer to conclude a purchase contract.
Only after he has selected the goods does the customer make a binding offer to purchase the goods at the end of the ordering process by clicking on the „Pay total amount via PayPal“ button. After receipt of payment, the customer receives an email with a summary of the order and an order confirmation to the email address given by him.

PAYMENT
MAKE TYPE NOT WAR! accepts the payment methods indicated on the website. Unless otherwise agreed, the purchase price must be paid after the purchase contract has been concluded and the invoice has been received.
DELIVERY LOCATION
The products bought on www.maketypenotwar.com can only be delivered to addresses in selected markets. MAKE TYPE NOT WAR! is not responsible for errors that the customer makes when confirming the order with this information or for delays resulting therefrom.
DELIVERY PERIOD
In general, the products will be delivered within the timeframe specified when choosing the shipping method. However, MAKE TYPE NOT WAR! cannot guarantee binding delivery times.
ACCEPTANCE OF PRODUCTS
If the customer is an entrepreneur, the product (s) purchased on www.maketypenotwar.com must be carefully checked after receipt by the customer or an authorized person to determine any damage. If the product (s) purchased on www.maketypenotwar.com is / are received by the customer in a damaged condition, the customer must immediately contact MAKE TYPE NOT WAR! Customer Service within seventy-two (72) hours by email at purchase @ maketypenotwar.com or by phone at +49 162 76 96 784. The customer must provide MAKE TYPE NOT WAR! with detailed information on the defects found and keep the original packaging of the product and the package in which it was delivered in the same condition in which it was received, otherwise following the instructions given by the customer service representative. The customer service then initiates its investigations with the transport company.
NON-BINDING INFORMATION ON EXERCISE OF THE RIGHT OF WITHDRAWAL
Although the customer is not obliged to do so, MAKE TYPE NOT WAR! asks the customer to use secure packaging – if possible, the original packaging – for returning the goods in order to avoid transport damage.
RESERVATION OF TITLE AND RISK TRANSFER
The company MAKE TYPE NOT WAR! remains the owner of the ordered products (hardware) until the full payment amount for the products has been received by MAKE TYPE NOT WAR!. If the customer is an entrepreneur (see definition of this term above), the risk of loss or damage to the products mentioned and any damage that may have occurred shall pass to the customer after shipment.
PRODUCT RETURN
Products purchased through www.maketypenotwar.com can be returned within a period of fourteen (30) days from confirmation of dispatch. The prerequisite is that the ordered products are returned in a new condition and in their original packaging. Shipping costs will not be returned. Please mark your package with „Return for MAKE TYPE NOT WAR!“.

WARRANTY
Subject to warranted properties, the material warranty with regard to any defects is excluded. The warranty also excludes damage for which the buyer is responsible, e.g. have arisen as a result of improper handling, in particular also inadequate packaging when returned.
LIABILITY
For cases of breach of duty and for unlawful acts as well as for compensation claims for unnecessary expenses, claims against the company MAKE TYPE NOT WAR! and its deputy agents and parties who have been employed to fulfill a contractual obligation for which the client is liable are excluded. The aforementioned limitation of liability does not apply if the damage in question was caused intentionally or in a grossly negligent manner.
JURISDICTION AND APPLICABLE LAW
The exclusive place of jurisdiction is Berlin. German law applies exclusively to these conditions of sale. The application of the Vienna Sales Convention is excluded.
